First part: Cell Tower Leases and Sales
Municipalities frequently lease space on buildings, water towers or land for cell towers and related uses. This program will describe typical
rental rates, key terms of such leases that can and should be present to protect the municipality and its future use of the building, structure
or land on which the lease is located.
The program will also describe situations where municipal sales of existing cell leases are beneficial to municipalities, how to get the best
price and terms, considerations unique to municipalities, and the main terms of the roughly 25-page document by which such rights are sold, while
preserving and protecting the balance of the property for municipal use.
Second Part: Cell Tower Changes/FCC Wireless Siting Order
The FCC's Wireless Siting Order preempts zoning approval for modifications to cell towers and other communications towers.
This portion of the program will provide a summary of the Federal law on cell tower zoning and cover legal and technical issues under the Wireless
Siting Order, including, what types of changes and modifications are covered, the preservation of requirements to comply with building codes, and
the differing rules for antennas on buildings, in highways and on camouflaged towers. The 60-day shot clock to act on qualifying changes and "deemed
granted" remedy will be covered, as well as Constitutional challenges to the Order that have not yet been addressed in the Ninth Circuit. It will
also address current efforts to further preempt local permitting and approval for cell towers and small cell sites in the rights of way.
Who: John Pestle
John Pestle is Chair of the Telecommunications Group at the Varnum Law Firm and is admitted to practice in Arizona and Michigan. For 20 years he
has represented municipalities and property owners in many states on cell tower leases, including on the sale of over 70 such leases and future
leasing rights. John is a graduate of Harvard College, Yale Graduate School, and the University of Michigan Law School. He held an FCC license to
work on radio, TV and ship radar transmitters and is a past Chair of the Municipal Lawyers Section of the State Bar of Michigan.

Who: Dr. Beverly Browning ("Dr. Bev")
Dr. Browning brings over four decades of experience to her annual League training events. She has assisted municipal and other types of clients and
previous workshop participants in winning grant awards of more than $430 million. Dr. Bev is the author of 42 grant-related publications.
